According to Article 4(3) and Article 8(6) of the Roaming Regulation (2022/612/EU), BEREC must update its Retail Roaming Guidelines in close cooperation with the Commission and consult with stakeholders for the purpose of ensuring a consistent application of the provisions.
Following consultation in June 2022, BEREC has now published revised Guidelines, which are designed to explain the Roaming Regulation, including the Commission Implementing Regulation (2016/2286/EU). The Guidelines set out: (i) detailed rules on the application of a “fair use policy”; (ii) the methodology for assessing the sustainability of abolishing retail roaming surcharges; and (iii) the application to be submitted by a roaming provider for the purposes of the sustainability assessment.
